and before an idiot chimes in with ichigo being a living soul reaper... first, he's a substitute, second, he basically has to be dead, even if just temporarily, to go into that form, because its his soul, not his body.
so, i dont think an underage dead girl has to worry about marriage.

As for shinigami, you're right on the first part and wrong on the second... they are souls and souls can be living or deceased. However, in order to become part of soul society you have to have physically died. Ichigo is not physically dead. We don't know for 100% certain if Hiyori is physically dead, but it's probably a safe bet she is.
Finally, didn't Byakuya and Rukia's sister get married in canon? Therefore marriages in soul society can occur.
